KVKK ve GDPR Aydınlatma Metni

Bu metin, 6698 sayılı Kişisel Verilerin Korunması Kanunu (KVKK) ve AB Genel Veri Koruma Tüzüğü (GDPR) kapsamında sizi bilgilendirmek için hazırlanmıştır.

Veri sorumlusu

ACOPES AI, Türkiye'de yerleşik bireysel bir geliştirici tarafından işletilen bir dijital hizmettir. Henüz bir şirket kurulmamıştır; şirketleşme tamamlandığında bu metinler yeni unvan ve adresle güncellenecektir.

İşlenen veriler ve amaçlar

İşlediğimiz veri kategorileri ve amaçları Gizlilik Politikası sayfasında ayrıntılı olarak listelenmiştir: kimlik ve iletişim (e-posta), müşteri işlem (plan, kullanım, üretilen içerik), işlem güvenliği (IP, oturum ve istek kayıtları) ve bağlı Etsy mağaza verileri.

Hukuki sebepler

• Sözleşmenin kurulması ve ifası (KVKK m.5/2-c; GDPR m.6/1-b) — hesabınızı açmak ve istediğiniz hizmeti sunmak.
• Hukuki yükümlülük (KVKK m.5/2-ç; GDPR m.6/1-c) — fatura ve kayıt saklama.
• Meşru menfaat (KVKK m.5/2-f; GDPR m.6/1-f) — güvenlik, kötüye kullanımın önlenmesi, hizmetin iyileştirilmesi.
• Açık rıza (KVKK m.5/1, m.9; GDPR m.6/1-a, m.49) — yurt dışındaki hizmet sağlayıcılara aktarım ve isteğe bağlı entegrasyonlar (ör. Instagram).

Yurt dışına aktarım

Hizmeti sunmak için kullandığımız sağlayıcıların (OpenAI, Google, Ideogram, Runware, Runway, remove.bg, Backblaze, Resend, Polar, Etsy) sunucuları çoğunlukla ABD ve AB'dedir. Kayıt sırasında verdiğiniz onayla verileriniz yalnızca ilgili işin gerektirdiği ölçüde bu sağlayıcılara aktarılır. Bu sağlayıcılar kendi veri koruma sözleşmeleri ve standart sözleşme maddeleri kapsamında çalışır.

Haklarınız (KVKK m.11, GDPR m.15–22)

• Verilerinizin işlenip işlenmediğini öğrenme ve bilgi isteme,
• İşlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme,
• Aktarıldığı üçüncü kişileri bilme,
• Eksik veya yanlış verilerin düzeltilmesini isteme,
• Verilerin silinmesini veya yok edilmesini isteme,
• Verilerinizi taşınabilir bir biçimde alma,
• Otomatik sistemlerle yapılan analiz sonucu aleyhinize bir sonuca itiraz etme,
• Kanuna aykırı işleme nedeniyle zarara uğramanız hâlinde zararın giderilmesini isteme,
• Açık rızanızı her zaman geri alma.

Nasıl başvurulur?

Hesabınızın e-posta adresinden support@acopesai.com adresine talebinizi ve türünü (erişim, düzeltme, silme, taşıma vb.) yazın. Başvurunuzu en geç 30 gün içinde ücretsiz olarak sonuçlandırırız. Yanıtımızdan memnun kalmazsanız Kişisel Verileri Koruma Kurulu'na, AB'de yaşıyorsanız ülkenizin veri koruma otoritesine şikâyette bulunabilirsiniz.

ACOPES AI is a digital service operated by an individual developer based in Türkiye. No company has been incorporated yet; these documents will be updated with the new legal name and address once it is.

Data and purposes

The categories of data we process and why are listed in detail in the Privacy Policy: identity and contact (email), customer transactions (plan, usage, generated content), transaction security (IP, session and request logs) and connected Etsy shop data.

Legal bases

• Performance of a contract (KVKK 5/2-c; GDPR 6(1)(b)) — creating your account and providing the service you ask for.
• Legal obligation (KVKK 5/2-ç; GDPR 6(1)(c)) — keeping invoices and records.
• Legitimate interest (KVKK 5/2-f; GDPR 6(1)(f)) — security, abuse prevention, improving the service.
• Explicit consent (KVKK 5/1, 9; GDPR 6(1)(a), 49) — transfers to providers abroad and optional integrations (e.g. Instagram).

International transfers

The providers we use to run the service (OpenAI, Google, Ideogram, Runware, Runway, remove.bg, Backblaze, Resend, Polar, Etsy) mostly host their servers in the US and EU. With the consent you give at sign-up, your data is transferred to them only as far as each job requires. These providers operate under their own data-processing agreements and standard contractual clauses.

Your rights (KVKK Art. 11, GDPR Art. 15–22)

• Learn whether your data is processed and request information about it,
• Learn the purpose of processing and whether it is used accordingly,
• Know the third parties it is transferred to,
• Have incomplete or inaccurate data corrected,
• Have your data deleted or destroyed,
• Receive your data in a portable format,
• Object to an outcome against you produced solely by automated analysis,
• Claim compensation for damage caused by unlawful processing,
• Withdraw your consent at any time.

How to make a request

Email support@acopesai.com from your account email address with your request and its type (access, correction, deletion, export, etc.). We complete requests free of charge within 30 days. If you're not satisfied with our answer, you can complain to Türkiye's Personal Data Protection Authority, or, if you live in the EU, to your local data protection authority.
